Thus, the two terms, although similar, are intended to identify two distinct translation services.
What is the sworn translation service
We provide sworn translations with a team of professional mother-tongue translators who work daily in the field and are continuously updated on new regulations in the field of sworn translations. Sworn translation is a written document with legal value, which becomes official when the translator declares that the translation is faithful to the original text, in court before a court clerk and a public official, or before a notary public. This service makes it possible to obtain a document with legal value abroad. By signing the report, the translator officially assumes civil and criminal liability for the translation. One € 16.00 revenue stamp must be affixed to every 4 pages (each page cannot have more than 25 lines) of the translated document, including the sworn statement.
Sworn translations for birth, marriage and residence certificates
One of the most frequently asked questions by our customers concerns sworn translations of birth or marriage certificates for residence or transcription/registration. These documents are required in the Italian municipality for both residence and marriage registration. In both cases, the certificates should be translated into Italian.
The problem arises when the municipality does not provide all the necessary information on how the translation should be done, or when even the clerk of the registry office does not know exactly what needs to be done. The most frequent mistake is to make a sworn (legalised) translation in the country where the certificate is issued without affixing a stamp called an ‘apostille’ on the translation. The apostille is a certification that validates, with full legal value at international level, the authenticity of any public document, and in particular of a notarial deed. This legal institution, although little known in the media, is recognised by states that have signed the Hague Convention of 5 October 1961, thus proving the full validity of the deed to which it is affixed. Alternatively, legalisation must be carried out at the Ministry of Foreign Affairs, Prefectures or other competent bodies, always in the country of origin. Another factor that leads to the submission of an incorrect translation from a legal point of view is not affixing the aforementioned stamps also on the original documents. If you find yourself in Italy with an apostilled birth or marriage certificate on the original, the right and quickest thing to do is to proceed with a sworn/sworn translation in Italy. This type of translation, made by a translator who swears the document in the court of jurisdiction on Italian territory, does not require an apostille.
Warning!!! By following this procedure, you will no longer need an apostille or legalisation on the translation; the requirement remains that the original document must bear one of the above-mentioned stamps, applied in the country where the document was issued. Another solution would be to take a multilingual Extract of the Birth, Marriage or Death Certificate to the commune. In this case, the Vienna Agreement, an international convention relating to the issue of multilingual extracts of civil status records (Vienna Convention of 08/09/1976 – ICCS Convention No. 16), to which the following States are parties, applies: Austria, Belgium, Bosnia-Herzegovina, Croatia, Estonia, France, Germany, Italy, Lithuania, Luxembourg, Macedonia, Moldova, Montenegro, Netherlands, Poland, Portugal, Romania, Serbia, Slovenia, Spain, Switzerland, Turkey.
The special feature of these extracts is that they are exempt from any translation and legalisation. Cost of application in the municipality: ZERO. The only drawback is the obligation to deliver the original to the Commune where we present it; we cannot leave a simple copy of it, so in the event of further need, you have to go to the Commune of your place of birth again and request another one.
